Final Settlement in Hepatitis Case

On Monday, Health Plan of Nevada reached a settlement with all those remaining clients who alleged they contracted hepatitis C at endoscopy clinics owned by Dr. Dipak Desai.

The lawsuit involved 62 year old Bernard Paul who was required by his insurance company to obtain health care from certain providers. He was treated at Desai’s clinics in 2005 and 2007 and there he contracted hepatitis.

According to their lawyer the terms of the settlement are confidential, but last year, a jury ordered the insurance company to pay $524 million to three people, two of whom contracted hepatitis C at a facility operated by Desai.

The lawsuit named the insurance company, Health Plan of Nevada and its former parent company, Sierra Health Services Inc. as they owned a duty to ensure that the medical practices they asked clients to use were safe.

In July 2013, Desai was convicted by a jury of 27 criminal counts in relation to hepatitis cases, including second degree murder due to the death of 77 year old Rodolfo Meana from the disease. He was sentenced to life in prison.

Motorcycle Accident involving Delivery Service Costs Millions

Jimmy John has reached a multimillion dollar settlement in Las Vegas with a motorcyclist who collided with a Jimmy John’s delivery vehicle.

In October 2011, Ty Cirillo, aged 19 at the time, was headed east on Oakey Boulevard on his way to work on his Harley-Davidson Sportster, when a Jimmy John’s delivery driver in a Chevy Blazer turned left onto Ivanhoe Way and cut him off. Cirillo suffered multiple horrific injuries after slammed into the right rear side of the SUV. His pelvis was cut wide open and he had multiple broken limbs. He has since had two hip replacements and is in a wheelchair, unlikely to ever walk or work again

The delivery driver said that the quicker the service, the bigger his tips were, and he also received a percentage of the sales for each delivery, so the more deliveries he made the more money he earned.

The actual amount of the settlement has not been revealed, although $50 million was requested. It is thought to be several millions.

Sheriff Seriously Injured Responding to Bus Crash

Sheriff Kenneth Jones from Eureka County was seriously injured on Saturday when travelling to respond to an accident.

According to the Sheriff’s office, Nevada Highway Patrol said that a Coach USA bus was travelling on a country road around 15 miles north of Carlin. The weather conditions were poor, with high winds and roads covered in sleet and snow. The bus drifted to one side of the road and the driver over corrected causing the bus to run off the road and overturn. There were nine passengers in the bus, four of whom were trapped, necessitating extrication. All passengers were taken to Northeastern Nevada Regional Hospital, but none were seriously injured.

Sheriff Jones was on his way to the scene of the accident when his vehicle left the Newmont Mine Highway. When emergency responders arrived he was both conscious and alert. He was taken to NNRH, but was later transferred to Renown Regional Medical Center in Reno for treatment.

He is expected to make a full recovery.

Traffic Cameras Not Used for Law Enforcement

Residents on the east side of the valley are wondering if cameras might lessen the number of car crashes at the corner of Viking and Sandhill roads.

The intersection has a traffic signal but according to neighbors, drivers always try and beat the light.

However, according to the Nevada Department of Transportation and the Regional Transportation Commission traffic cameras are only used to observe traffic patterns and there are currently 450 cameras around the valley operated by the Freeway and Arterial System of Transportation program, known as FAST.

The cameras do not record video and nor are they used for law enforcement purposes as Nevada law prohibits the use of speed or red light cameras except under a very few circumstances.

The media states that the devices are considered controversial and efforts to get them approved in Nevada have not gained much support in the state legislature.

Accident Avoidance and Safe Driving Tips

When people first start out as drivers on the road at a young age, there is a very common tendency to be nervous about getting behind the wheel. As drivers gain more experience, however, the task of driving becomes increasingly second nature until eventually it is easy to take traffic, and traffic safety, for granted. But adopting good driving habits is about avoiding accidents in order to keep yourself and others safe on the road.

  • Avoid drowsy driving. Driving when you haven’t had sufficient rest can be as potentially dangerous as driving under the influence of drugs or alcohol.
  • Cell phones are one of the most common driving distractions and have been the cause of countless accidents. If you have to talk on your cell phone, use a hands-free device or the speaker phone feature on your phone and NEVER send or read text messages or emails from your cell phone while driving.
  • Make seat belts a rule for everyone in your vehicle. Seat belts are proven to save lives and substantially reduce the risk of serious injury in the event of a car crash. Make sure that everyone in your vehicle wears their seat belt when you are behind the wheel.

Rains Cause More than a Million in Damage

According to officers, torrential rains that drenched much of the U.S. Southwest earlier this week caused more than $1 million worth of damage to roadways in Nevada county.

Clark County spokeswoman, Stacey Welling, said that nearly 140 homes in Clark County suffered damage and preliminary reports from the county’s public works department put the expense of cleaning and repairing field roadways at around $1.1 million, and they anticipate recovery attempts to take 30 days to complete.

Welling stated that over half of the dirt roads in Sandy Valley, some 50 miles southwest of Las Vegas, would require $427,000 worth of work alone,

She said that the Division of Emergency Services was still working to provide a complete tally of the storm’s harm.

The rains prompted flash-flood warnings for areas of Arizona, California, Nevada and Utah.

Trooper Chelsea Webster of the Nevada Highway Patrol stated emergency workers rescued at least 15 marooned drivers from their cars and police responded to almost 70 accidents in the Las Vegas field tracking the storm.
