Final Settlement in Hepatitis Case

On Monday, Health Plan of Nevada reached a settlement with all those remaining clients who alleged they contracted hepatitis C at endoscopy clinics owned by Dr. Dipak Desai.

The lawsuit involved 62 year old Bernard Paul who was required by his insurance company to obtain health care from certain providers. He was treated at Desai’s clinics in 2005 and 2007 and there he contracted hepatitis.

According to their lawyer the terms of the settlement are confidential, but last year, a jury ordered the insurance company to pay $524 million to three people, two of whom contracted hepatitis C at a facility operated by Desai.

The lawsuit named the insurance company, Health Plan of Nevada and its former parent company, Sierra Health Services Inc. as they owned a duty to ensure that the medical practices they asked clients to use were safe.

In July 2013, Desai was convicted by a jury of 27 criminal counts in relation to hepatitis cases, including second degree murder due to the death of 77 year old Rodolfo Meana from the disease. He was sentenced to life in prison.
